Is Plan B Legal in Texas?

Plan B (levonorgestrel), also known as the “morning-after pill,” is legal in Texas. You can buy it over the counter at pharmacies, grocery stores, and some clinics without a prescription, and there is no age restriction on purchasing it.

Texas abortion laws do not apply to Plan B because Plan B is not an abortion pill. It does not end a pregnancy. It works before pregnancy starts by preventing or delaying ovulation.

What Plan B Does — and Doesn’t Do

 Plan B

Plan B DOES:

  • Prevent ovulation
  • Reduce the chance of fertilization
  • Work best when taken within 72 hours after unprotected sex

Plan B DOES NOT:

  • End a pregnancy
  • Affect an existing pregnancy
  • Work like abortion medication (which is restricted in Texas)

Because of this, Texas law does not restrict or ban access to Plan B.

Where You Can Buy Plan B in Texas

  • CVS
  • Walgreens
  • Walmart
  • Grocery-store pharmacies
  • Amazon and other online retailers
  • Urgent care clinics and women’s health clinics

You can walk in and buy it directly off the shelf. No ID, no prescription.

Texas Laws Don’t Apply to Emergency Contraception

Texas abortion bans do not include:

  • Plan B
  • Ella (ulipristal emergency contraception)
  • Birth control pills
  • IUDs
  • Contraceptive implants
  • Condoms
  • Any form of contraception used to prevent pregnancy

Texas law specifically targets abortion procedures, not contraception.

Important Things to Know

  • Some individual pharmacists may refuse to sell Plan B for personal beliefs, but another pharmacist or another store can legally sell it.
  • Hospitals are not required by Texas law to provide Plan B, but many do depending on their policies.
  • Insurance coverage varies — some plans cover emergency contraception, and some do not.
  • Plan B remains widely available even after changes to abortion laws in 2022 and later. Nothing in 2023–2025 legislative sessions changed its status.

Update & Clarifications

Everything outlined above about Plan B is accurate, but here are a few extra points that help clear up the confusion many Texans still have:

Plan B Is Fully Legal in Texas

Plan B is still legal across the state in 2025. Texas has no law restricting its sale, possession, or use. Pharmacies can sell it over the counter, and anyone can buy it without showing ID or getting a prescription. Texas follows the federal FDA rules exactly.

Abortion Laws Do Not Affect Emergency Contraception

The strict abortion bans in Texas apply only to abortion procedures and abortion-inducing drugs like mifepristone and misoprostol.
Plan B does not fall into that category.
It works before pregnancy starts — mainly by delaying ovulation — and does not end an existing pregnancy. That’s why none of the Texas abortion laws apply to it.

Pharmacist Refusal Policies Can Cause Confusion

While Plan B is legal, you might still encounter a pharmacist who refuses to sell it based on personal beliefs. Texas allows this, but the pharmacy must make sure you can still obtain the medication, either through another pharmacist or a nearby location. So the drug remains legal and available, even if access can sometimes feel inconsistent.

Why So Much Confusion Still Exists

Even though Plan B is legal, Texas’s abortion restrictions have caused many people to assume emergency contraception is banned too. That’s not the case. Plan B has never been included in the abortion laws. The confusion comes from the overlapping discussions about reproductive healthcare in general.

Difference Between Plan B and Ella

Plan B is fully over-the-counter with no prescription needed.
Ella (ulipristal acetate), another emergency contraception pill, is also legal in Texas but requires a prescription. That can make it harder to access quickly, especially for minors or people without easy access to a doctor.

Final Take

Yes — Plan B is fully legal in Texas, available over the counter, and not restricted by the state’s abortion laws. Adults and teens can buy it directly without a prescription. If you need it, you can walk into most pharmacies and purchase it discreetly.
