If you’re in Texas and trying to figure out whether vaping is legal, the answer is yes, adults can vape. But Texas passed a major law (SB 2024) that takes effect September 1, 2025, and it bans the sale of most vapes inside the state. You can still use nicotine vapes as an adult, but what you are able to legally buy in Texas is now extremely limited.
Texas did not criminalize adult vaping, but it targeted retailers, distributors, and vape shops with strict product bans. If you vape, especially if you use disposables or CBD/Delta products, you need to understand these new rules.
Vaping in Texas: What the Law Allows

✔ Vaping is legal for adults age 21+
Texas law allows adults to use vaping devices and nicotine liquids. You can legally own vapes, carry them, and use them in places where local ordinances allow it.
✔ Possession is not criminalized
Even under the new SB 2024 ban, the law targets sales, not possession. If you already own nicotine vapes or obtain them legally from out of state, you can still vape them.
✔ Medical cannabis vapes remain legal for registered patients
Low-THC medical cannabis (under the Texas Compassionate Use Program) is the only cannabinoid vaping category that remains legal for sale in Texas.
The Vape Product Sales Ban (SB 2024 — Effective Sept 1, 2025)
Senate Bill 2024 reshapes the entire vape market in Texas. The law makes certain products illegal to sell but not illegal to possess. The goal was to reduce youth access and stop the booming Delta-8/Delta-9 vape market.
Here are the three major bans:
1. Ban on Selling Cannabinoid Vapes in Texas
Texas has completely banned the sale of any vape containing cannabinoids, including:
- Delta-8
- Delta-9
- CBD
- THCA
- HHC and similar cannabinoids
- Any hemp-derived THC product
Exception: Low-THC medical cannabis vapes under the Compassionate Use Program.
Penalty: This is a Class A misdemeanor for the retailer.
2. Ban on Most Disposable Nicotine Vapes (China-Origin Ban)
Instead of banning flavors outright, Texas banned the sale of disposable nicotine vapes manufactured in China or marketed by Chinese brands. Since most flavored disposables come from these sources, this becomes a de facto flavor ban.
What this eliminates from Texas stores:
- Elf Bar
- Lost Mary
- Funky Republic
- EB Create
- Most fruity-flavored disposables
Shops that continue to sell these devices risk losing licenses and facing criminal charges.
3. Ban on “Minor-Appealing” Vape Products
Retailers can no longer sell vapes that:
- Look like pens, USB drives, or highlighters
- Use cartoon characters
- Use candy or snack-style packaging
- Are disguised as household objects
What You CAN and CANNOT Do in Texas (2025)
You CANNOT legally buy in Texas:
- Any CBD, Delta-8, Delta-9, or THCA vape
- Most flavored disposable nicotine vapes
- Any vape manufactured in China
- Any “disguised” or toy-like vape product
✔ You CAN legally do:
- Vape nicotine products you already own
- Buy nicotine vapes from online out-of-state retailers
- Vape in private areas or in public places where local rules allow it
- Use medical cannabis vapes if you are a registered CUP patient
SB 2024 targets retailers, not adults. You are not breaking the law simply by vaping.
Indoor Use Rules: State vs. Local Laws
Texas does not have a statewide indoor vaping ban, but local governments do.
Stronger city rules in 2025:
- San Antonio bans vaping anywhere smoking is banned (effective Jan 1, 2025).
- Austin, Houston, Dallas, El Paso, and other cities have similar rules.
So, while state law is mild, city laws are much stricter, and most public indoor spaces now prohibit vaping.
Age Requirements and Retail Rules (Still in Effect)
- Must be 21+ to purchase or possess nicotine vapes.
- Retailers must verify ID for anyone appearing under 30.
- Selling banned vape products = Class A misdemeanor.
- Selling to minors brings fines, license suspension, or closure.
What Happens If You Break the Rules?
For retailers:
- Selling banned vapes = Class A misdemeanor
- Up to 1 year in jail and $4,000 fine
- Loss of retail permits
For individuals:
- No penalty for possession of nicotine vapes
- Using a vape with illegal drugs (high-THC oil, illicit substances) = felony
Final Take
Vaping is still legal for adults in Texas, but the state has made it much harder to buy many products. SB 2024 bans the in-state sale of all cannabinoid vapes and most flavored disposable nicotine vapes. You can still vape what you legally possess, buy from out-of-state vendors, or use medical cannabis vapes if you qualify — but Texas vape shops now face strict limits.
